RoHS Document Hierarchy

Order of Precedence

 

The RoHS Directive

In order to implement the RoHS Directive, it is vital to appreciate the hierarchy of documentation that has been generation as a result of the Directive
The WEEE Directive
(2002 / 96 / EC)
Clearly the principal document is the RoHS Directive itself, although the scope and many of the principles are taken from the WEEE Directive.

Amendments to the RoHS Directive
(Commission Decisions 2005-618, 2005-717, 2005-747 & 2006-310)

Amendments to the RoHS Directive are published as necessary and are particularly likely to include further exemptions as they are agreed by the European Commission.

Member States' individual implementations

RoHS Enforcement bodies ARE actually obliged TO enforce NATIONAL Statutory Instruments. Although RoHS IS a single market Directive, subtle differences do exist. (e.g. UK S.I. 2006 1463).

Court Rulings AT the NATIONAL LEVEL, a history OF legal precedents IS likely TO develop. These will effectively augment the NATIONAL legislation.

The Commission's FAQs The Commission regularly updates their published WEEE and RoHS FAQs. These change periodically to reflect new decisions, agreed exemptions and seek to address new concerns and queries raised by industry.

The DTI Guide There IS also SOME NATIONAL guidance offered by the relevant ministries OF member states. Examples include the ElectroG IN Germany, VROM IN the Netherlands AND the DTI IN the United Kingdom.

The Enforcers' Guidance This Paper is established to encourage all member state enforcement authorities to apply market surveillance and enforcement activities in a common manner.

Industry Advisors' Papers AS the method OF confirming compliance IS self declaration AND industry groups ARE encouraged TO WORK together TO improve chain management AND visible evidence OF compliance, industry groups may produce meaningful guidance.

Certification Bodies' Guidance The UK RoHS Conformity Assessment Group (URCAG) has pioneered and agreed with the UK enforcement Authority, a common approach to assessing and registering the ability of producers and suppliers to achieve and manage RoHS compliance. Through the URCAG Website, a number of useful guidance papers could be issued.
